In Monday's edition of NLJ's Supreme Court Brief, we examined the court's dismissal of an Oklahoma abortion case -- and the reality that the justices will return to the abortion issue later this term. We also reported on some of the advocates who will argue before the court this week and next, including Douglas Laycock's late entry into a public prayer case and Eric Schnapper's busy schedule of two arguments within the space of eight days. We also took a look at Chief Justice John Roberts Jr.'s signal that he wants to scrutinize another aspect of class actions -- so-called "cy pres" settlements. Today's issue, featuring reports on arguments in a major test of congressional power and other court actions, will be emailed to subscribers by late afternoon.
